Haley Joel Osment has been charged with drink-driving and possession of marijuana.
If convicted, The Sixth Sense star, now 18, could face a jail term.
Haley was arrested on suspicion of drink-driving after he crashed his car in La Canada Flintridge, California, on 20th July 2006.
He broke a rib and injured his shoulder when his car flipped over.
Haley was charged with misdemeanour driving, driving with a 0.15 percent or higher blood-alcohol content and possession of marijuana while driving.
In addition, he was charged with driving with a 0.05 per cent blood-alcohol content under the age of 21.
The legal limit for drinking is 21 in the United States.
Haley will appear in court on 19th September.
